*✦ Agar kisi Shia ka Aqidah ye ho ke Qur'an me tehreef (Raddo badal) hui hai, ya jibraeel Ameen se wahee pahunchane me ghalti hui hai, ya Hazart Ayesha Rz par bohtaan bandhta ho, ya unke jo 12 imam hain unke baare me is baat ka qail ho ke unko halal wa haram ka ikhtiyaar hai, ya Allah Ta'ala se ghalti ke sudoor ka qail ho, ya uske alawa koi kufriya aqidah rakhta ho to is tarah ke aqaid ka hamil koi bhi fard muslmaan nahi hai, lihaza mazkura aqaid rakhne wali shia khatoon se kisi Sunni ladke ka nikah jaiz nahi hai, agar wo nikah kar le to wo nikah kala'adam shumar hoga, aur fil for alahedgi lazim hogi, Albatta agar shia khatoon apne batil kufriya aqaid se sacche dil se tauba kar ke mu'tabar gawaho ke samne islami aqaid ke etraf ke sath sath shia ke batil aqaid se mukammal bara'at ka izhar kare aur sahi islami aqaid ka dil o jaan se iqrar kar le to us se nikah jaiz hoga*

*✦ Mangni nikah ka wada hai, Nikah nahi hai, mangni karne ke baad bhi mangetar digar ajnabi ladkiyo ki tarah na mehram hi hoti hai, aur na mehram ladki se ta'alluqat rakhna, milna julna, aur hansi mazaq ya bagher zarurat baat cheet karna jaiz nahi hai, aur massege par bhi ta'aluqat rakhne ka yahi hukm hai, neez hamare muashre ka ye almiyah hai mangni ek taweel zamane tak chalti rehti hai, aur mard o zan mangni ke baad ek dusre se milte julte hain,aur usme kisi Qism ki qabahat mehsoos nahi karte, balke unke khandaan wale bhi usko bura nahi samjhte, halanke Shar'an ye bilkul na jaiz hai, behtar aur samjhdari ki rah ye hai ke, mangni ke baad nikah aur rukhsati me takhir na ki jaaye, lihaza agar fitne me mubtala ka andesha hai to jldi rukhsati ka intizaam kiya jaaye*

*✦ Ladki ke liye apne razai bhai ke bhai se nikah is surat me jaiz hai jab wo mazkurah ladki ka razai bhai na ho, Maslan agar zaid aur bakar bhai ho aur Fatima jo unke liye ajnabi ho, fir Fatima ne zaid ki waldah ka doodh piya, to zaid ki waldah ki tamam awlaad se Fatima ka raza'at ka rishta ho gaya, lihaza ab Fatima ka zaid ke bhai bakar se rishta na jaiz ho gaya, Albatta agar Fatima ne zaid ki waldah ka doodh na piya ho, balke zaid ne Fatima ki waldah ka doodh piya ho, to Fatima ka zaid ki waldah ki awlaad se raza'at ka rishta nahi hoga, lihaza is surat me Fatima ka zaid ke bhai bakar se rishta karna jaiz hai*

*✦ 2. Agar wo ghair muslim aurat ahle kitab ( yahi yahudi ya isai mazhab ki ho) ho to usse nikah karna makrooh hai, kyunke mojuda zamane me unke sath budobaash ki surat me apne ya apne baccho ke deen aur unke islami riwayat ko bachana mushkil hai*

*✦ Shariyate mutahharah me mard ko bayak waqt char shadiya karne ki ijazat hai, basharte ke biwiyo ke darmiyan adal aur barabri kar sake, aur shadi ke sath mard aur aurat ke darmiyan kai huqooq mutalliq hote hain, ye ta'alluqat sirf hambistari tak mehdood nahi hai, balke shadi ki surat me biwi ka mehar, naan aur nafqa، uski rihaish ka intezaam, zawjain me se kisi ek ke intiqaal ke baad dusre ka uske tarke me hisse daar Banna wagera shamil hai, isi wajah se shariyat ne shadi me gawaho ki shart lagayi hai, take logo ko shadi ka ilm ho aur tohmat ka andesha na ho, aur unke huqooq ka thaffuz ho sake, dusri shadi karne se ye tamam huqooq dusri biwi ke liye bhi sabit ho jaate hain aur uske sath sath dono biwiyo ke darmiyan tamam muamlaat ( nafqa, rihaish, aur raat guzarne) me barabri zaroori hai, han agr koi aurat apne shohar ke sath raat guzarne se dast bardar ho jaaye to uski gunjaish hai,aur jab us haq ko wapas lena chahe to le sakti hai, is surat me shohar par dono biwiyo ke darmiyan raat guzarne ki baari muqarrar karna lazim hoga , Albatta har biwi ke sath hambistari karne me barabri zaruri nahi hai, baqi nafqa shohr par har haal me lazim hai, biwi ke nafqe se dast bardar hone se nafqa maaf nahi hota*

*✦ Lihaza agar kisi majlis me aaqidain to mojud ho, lekin gawahan mojud na ho, balke gawahan nikah ki karawayi ko online sun rahe ho, to is tarah krne se nikah Mun'aqid nahi hoga*.

*✿●•· Agar zaid ne apni beti ka nikah Khalid se baqayeda mehar tai kar ke kar diya, aur phir Khalid ne bhi apni beti ka nikah zaid se mustaqil mehar tai karke kar diya to ye nikah durst hai, aur ye nikah shigar nahi hai, Albatta zaid aur Khalid me se har ek apni beti ki shadi dusre se is shart par kare ke har ek dusre ko apni beti nikah me dega aur haqq e mehar nahi hoga, yani ke ek ladki ke badle me dusri ladki ki jaaye, aisi surat ko shigar kahte hain, jis se Rasoolullah ﷺ ne mana farmaya hai, jese ke hadees shareef me hai*

*✦ Hazrat Ibne Umair Rz se Riwayat hai ke Rasoolullah ﷺ ne nikahe shigar se mana farmaya hai, aur shigar ye he ke aadmi apni beti ka nikah is shart par kare ke wo apni beti ka nikah usse kar dega aur unke darmiyan mehar Muqarrar nahi kiya jaayega (yani dono aurton ko ek dusre ka mahr taswwur kiya jaayega)"*
*Lihaza Shar'an aisi shadi se mana kiya gaya hai, Albatta ulama e Ahnaaf ke nazdeek agar kisi ne kiya hai to nikah mukammal batil nahi hai balke nikah sahi hai aur aurat ko mehre misl diya jaayega aur awlaad bhi sabit nisbat hogi*

*✦ Chunke mehar biwi ka Shar'ee haq hai, nikah ke waqt mehar tai ho jaane ke baad biwi agar chahe to mehar me kami kar sakti hai aur agar chahe to pura mehar maaf bhi kar sakti hai,lekin bahami razamandi ke sath mehar tai ho jaane ke baad mard ke liye biwi se mehar kam krwane ya maaf karne ka mutalba karna durust nahi hai, shohar par tai shudah mehar dena hi laazim hai, Albatta shohar apni khushi se tai shudah mehar me beshi (zyadati) karna chahe aur biwi ko tai shudah mehar se zayada dena chahe to de sakta hai*

*✦ Aisi taqreebat to fi nafsihi to jaiz ho lekin usmegair shar'ee umoor ( Maslan makhlut ijtima, be pardagi, musici wagera) ka irtiqaab kiya ja raha ho unme shirkat ka hukm ye hai ke*

*✦ (1). Agar pehle se ye baat malum ho ke taqribaat me gair shar'ee umoor ka irtikaab hoga,to us surat me hargiz taqribaat me shirkat ke liye nahi jana chahiye, agarche apni taraf se mukammal parde ka khayal rakha jaaye, lekin mad'o shakhs koi aalim ya muqtada ho aur use ummid ho ke wo taqreeb me ja kar ma'asiyat ke irtikaab ko rok sakta hai, to use jana chahiye take uski wajah se dusre log bhi gunah ke irtikaab se bach jaayein*

*✦ (2). Agr pehle se ma'alum na ho ke wahan ma'asiyat ka irtiqaab ho raha hai, balke wahan ja kar malum ho to agar andr jane se pehle malum ho jaaye to wapas lot aaye, andar na jaaye, Albatta agar andar ja kar is ma'asiyat ko band karne par Qadir ho to andar ja kar is ma'asiyat ko band kara dain*

Agar andar dakhil hone ke baad ma'asiyat ke irtikaab ka ilm ho aur ma'asiyat ko band karne par qudrat bhi na ho, to mad'o shakhs agar aalim ya muqtada ho to wo waha na bethe,balke uth kar wapas chala jaaye, Kyunke uske wahan baithne me ilm ka istikhfaf ( toheen) hai, Albatta agar mad'o shakhs aam aadmi ho to wahan baith kar khana khane ki gunjaaish hai agar koi shakhs shar'ee hukm ke peshe nazar is tarah ki kisi taqreeb ya rusum me shirkat na kare to use qata rehmi ya qata talluqi nahi kaha jaayega, aur na use qata rehmi ya qata talluqi ka gunah milega, balke iman ka taqaza hone ki wajah se use us par sawab bhi milega*

*★ Nikah ke baad hattal imkaan rukhsati me bila wajah takhir nahi karna chahiye, kyunki sharee'at e mutahharah me baligh hone ke baad jald nikah karne ke ke jo maqasid hai,(Maslan iffat wa paakdamni ka husul) wo rukhsati se hi hasil ho sakte hain, Albatta kisi ma'aqul uzar, ( Maslan rihaish ka intizam wagera na hona) ki bina par agar rukhsati me kuch takhir ho jaaye to usme Shar'an harj nahi hai, aur nikah ke baad ladka aur ladki dono ki hesiyat ek dusre ke liye shohar aur biwi ki hai, chahe rukhsati na hui ho, is liye Shar'an kisi bhi tarah ka talluq rakhna mana nahi hai, Albatta behtar ye hai ke rukhsati se pehle ese talluqaat se parhez kiya jaaye jo khandaan aur muashre me nikah se pehle ma'aub samjhe jate ho, Kyunki ba'az auqat rukhsati se pehle be taklluf talluqaat se bahoot se mafasid peda ho jaate hain*.

Walid ya murabbi) ka naam le aur uski taraf ladki ko mansub kare to us ladki ka nikah sahi nahi hoga, Albatta agar ladki majlise nikah me khud hazir ho, aur bajaye wakeel ke khud ijaab o qubool karaye uski taraf ishara karke ijaab o qubool kiya jaaye, to waldiyat ki galti ki surat me nikah sahi ho jaayega, lihaza agar ladki majlise nikah me mojud na ho, ya mozood to ho lekin na to usne khud ijaab o qubool kiya ho aur na hi ijaab o qubool ke doran uski taraf ishara kiya gaya ho, to esi surat me ijaab o qubool ke doran us ldki ki waldiyat me tabdili karne ki surat me uska nikha nahi hoga*

*✦ Aur tajdeed e nikah ka tariqa ye hai ke do mard gawaho ya ek mard aur do aurto ki mojudgi mein bahami razamandi se naye mehar ke sath nikah ka ijaab o qubool kar liya jaaye, Maslan biwi kahe ke mene itne mehar ke badle apne aapko aapke nikah me diya, aur shohar kahe ke mene Qubool kiya, taham ahtiyat ki bina par nikah ki tajdeed ki gayi ho to naya mehar mutayyan karna zaruri nahi hai, aur us nafse nikah se (jab ke mehar me izafa Maqsood na ho) mehar bhi lazeem na hoga*

*✦ Nikah ke moqe par Miyan biwi ya unke khandaan walo ko barkat ki dua dena aur uske liye "shadi mubarak" ya "Mubarak ho" jese alfaz istemal karna hadis e mubaraka se sabit hai aur iske liye hadis me alfaz bhi manqool hain, Hazart Abu huraira Rz se marwi hai ke Rasoolullah ﷺ jab kisi aadmi ko shadi ki Mubarak baad dete to yun farmate ke "barakallahu laka wa baraka alaika wa jama'aa baynakuma fi khair" yani Allah Ta'ala tumhare liye is nikah ko mubark farmaye Allah tumpar apni rehmato ka nuzul farmaye aur tum dono ko behtreen tareeqe par jama rakhe, neez musnad e Ahmad me hai ke Abdullah bin Mohammad bin Aqeel kehte hain ke Hazrat Aqeel bin abi talib ki shadi hui aur pehli raat ke baad jab wo bahar aaye to hum ne un se kaha ke tum dono ke darmiyan ittefaq paida ho, aur ye nikah awlaad ka zariya bane, unhone farmaya thahriye, yun na kahe Kyunki Rasoolullah ﷺ ne hume isse mana farmaya hai, aur kaha hai yun kaha karo, "barakallahu laka wa baraka alaika" "wa baraka laka feeha" Allah tumhare liye use mubarak kare, tumhe barkate ata farmaye, aur us nikah me tum par khoob barkate nazil farmaye*
